If additional product or service conditions apply, the consumer may always rely on the provision that is most favorable to them.

If any provision is void or annulled, the remaining provisions remain in force and will be replaced by a provision that most closely reflects the original intent.

Situations not covered by these terms shall be assessed in the spirit of these terms.

Article 4 – The offer

If an offer has a limited validity period or conditions, this will be clearly stated.

The offer is non-binding. Chloe & Sophie Calgary reserves the right to modify or withdraw offers.

The offer contains a complete and accurate description of the products and/or services.

Images are a truthful representation, but color deviations may occur.

Errors or mistakes in the offer do not bind Chloe & Sophie Calgary.

Each offer clearly states pricing, shipping costs, payment methods, delivery terms, right of withdrawal, and contract duration.

Article 5 – The agreement

The agreement is concluded when the consumer accepts the offer and meets the stated conditions.

Electronic acceptance will be confirmed electronically.

Chloe & Sophie Calgary takes appropriate security measures for electronic transactions.

Chloe & Sophie Calgary may refuse an order or impose conditions if payment obligations cannot be met.

The consumer will receive written confirmation including withdrawal conditions, guarantees, and contact details.

Article 6 – Right of withdrawal

The consumer has the right to withdraw from the contract within 30 days after receipt of the product.

Products must be handled with care and returned in original condition where possible.

Withdrawal must be communicated in writing or by email.

Failure to notify or return within the stated periods makes the purchase final.

Article 7 – Costs in case of withdrawal

All return shipping costs, including international return shipping, are borne by the consumer.

Refunds will be issued within 30 days after receipt or proof of return.

Article 8 – Exclusion of the right of withdrawal

The right of withdrawal may be excluded for custom-made, personal, perishable, hygienic, or sealed products that have been opened.

Certain services are also excluded as legally permitted.

Article 9 – The price

Prices remain valid during the offer period unless legal changes apply.

Products shipped outside the EU may incur import VAT or customs costs payable by the consumer.

Chloe & Sophie Calgary is not liable for typographical pricing errors.

Article 10 – Conformity and warranty

Products comply with reasonable expectations and legal requirements.

Warranty corresponds to factory warranty and does not cover misuse or unauthorized modifications.

Article 11 – Delivery and execution

Orders are handled with care and delivered within 30 days unless otherwise agreed.

If delivery is delayed or impossible, the consumer may terminate the contract and receive a refund.

Risk transfers to the consumer upon delivery.

Article 12 – Long-term transactions

Consumers may terminate indefinite contracts at any time with one month’s notice.

Fixed-term contracts are not silently renewed except where legally permitted.

After one year, termination is always possible with one month’s notice.

Article 13 – Payment

Payment must be completed within 7 working days unless agreed otherwise.

Incorrect payment details must be reported immediately.

Reasonable costs may be charged in case of non-payment.

Article 14 – Complaints

Complaints must be submitted within 7 days of discovery.

Chloe & Sophie Calgary will respond within 30 days.

Valid complaints will result in repair, replacement, or appropriate compensation.

Article 15 – Disputes

All agreements between Chloe & Sophie Calgary and the consumer are governed exclusively by Dutch law.
